No more than 3 Commissioners can be of the same political party. The President chooses 1 Commissioner to act as Chairman.  \n\nCurrently, the FTC has 2 Democrats, Edith Rameriz (D) who is also Chairman, and Terrell McSweeny (D), and 1 Republican, Maureen Ohlhausen (R).  The remaining 2 seats were vacated by the early resignations of Joshua Wright (R) in August 2015 (pre-Vemma), and Julie Brill in March of 2016 (post-Vemma but pre-Herbalife settlement).  \n\nAt the time of the Vemma action in August 2015, the FTC temporarily had 4 Commissioners, 3 of which were Democrats (Rameriz, Brill & McSweeny) and 1 was Republican (Ohlhausen). At the time of the Herbalife settlement in July 2016, there were temporarily 3 Commissioners, with 2 Democrats (Rameriz & McSweeny) and 1 Republican (Ohlhausen).\n\nIn short, the next President will not only choose the next Chairman, but will also nominate all 5 Commissioners, with Rameriz being first (her term has already expired), then the 2 seats vacated by Brill (who seemed to be the lead Commissioner against Vemma) and Wright, then McSweeny in September 2017 and Ohlhausen in September 2018.\n\nHow does all this impact the network marketing profession?  Arguably the current FTC is the most aggressive in history when it comes to regulating and taking actions against network marketing.
